Advocacy for Inclusion does not offer advocacy for filling out NDIS applications.

If you have barriers in accessing these services please don’t hesitate to contact us for additional advocacy support.

How can we help with NDIS appeals? 

If you have applied to access the NDIS, or you have an NDIS Plan, the NDIA is going to make decisions about you.

These decisions may be about:

  • Your access to the scheme
  • The supports that are in your plan 
  • Your statement of participant supports
  • Whether a plan review should happen 
  • Whether you should have a plan nominee

Sometimes, you will not agree with the NDIA’s decision. You can contact Legal Aid, contact us, or ADACAS for help and advice.

Internal Review

The first thing you can do is ask the NDIA to remake their decision. This is an application for internal review.

AFI can help you understand how the internal review process works. If you would like to apply for an internal review, AFI can help you:

  • To apply for an internal review
  • To understand the law
  • To make sure that you have the right evidence
  • To collect more evidence
  • To communicate with the NDIA

Sometimes, it can take a long time for the NDIA to make an internal review decision. AFI can also help you with any delays in the internal review process.

External Review

You can ask the Administrative Appeals Tribunal (AAT) to remake the NDIA’s decision if you have received an internal review decision that you do not agree with. This is an application for external review.

AFI can help you understand how the external review process works. If you would like to apply for an external review, AFI can help you:

  • To apply for a review at the AAT
  • To understand the law
  • To make sure that you have the right evidence
  • To collect more evidence
  • To apply for Legal Aid
  • To attend meetings with the AAT
  • To communicate with the AAT
  • To communicate with the NDIA
  • To navigate any delays in the decision-making process

Once you have received an internal review decision, you only have 28 days to apply for an external review. If it has been more than 28 days, AFI may be able to help you apply for an extension of time.
